Platform Master Service Agreement

1. Preamble & Definitions

This Master Service Agreement ("MSA") is a legal contract between Kosovaks Systems Inc. ("Provider") and the entity utilizing the infrastructure ("Client"). By generating an API key, the Client acknowledges that this infrastructure is a Critical Notification Gateway, not a general-purpose email marketing service.

2. Commercial Qualification (B2B Only)

2.1 Legal Entity Requirement. The Service is strictly prohibited for use by individuals, consumers, or sole proprietorships acting outside of a registered trade context. Access is granted solely to verified legal entities (e.g., LLC, Inc., GmbH, Ltd) possessing a valid Tax ID or VAT number.

2.2 Verification. Kosovaks Systems reserves the right to suspend any Workspace that fails to provide proof of business incorporation within 24 hours of a request (KYB Check).

3. Permitted Traffic Types

To maintain high IP reputation for financial alerts, traffic is strictly categorized using the following definitions (aligned with Mailgun & AWS SES policies):

Authorized "Transactional" Traffic: Real-time alerts triggered by a recipient's interaction with the Client's application (e.g., 2FA codes, password resets, shipping confirmations, legal notices).
Prohibited "Marketing" Traffic: Any bulk transmission where the primary purpose is commercial advertisement, newsletters, or cold outreach.

Violation: Commingling marketing traffic with System Alerts is a material breach of this MSA.

4. Anti-Spam & Consent

4.1 Zero Tolerance Policy

We prohibit the use of purchased, rented, or third-party lists. Detection of spam traps or a complaint rate exceeding 0.08% will result in immediate API revocation.

4.2 Double Opt-In (COI)

The Client warrants that all recipients have provided explicit consent via a Confirmed Opt-In (Double Opt-In) mechanism. The Client must retain timestamped records of this consent.

Digital acceptance of this policy is recorded upon Workspace creation.
